A Labour Market Impact Assessment (“LMIA) is essentially an opinion from Employment and Social Development Canada (“ESDC”) that permits a Canadian employer to hire a foreign worker rather than a Canadian citizen or permanent resident. The purpose is to demonstrate that a Canadian citizen or permanent resident is not available and/or cannot be found to fulfill the role and therefore, more specifically, a foreign worker is not “taking away” any job opportunities from residents.

Please note that in order to be permitted to fill the role with a foreign worker, ESDC must issue a neutral/positive opinion to the employer for that role.

If you are interested in hiring a temporary foreign worker and need further clarity with respect to the LMIA process, including advertisement requirements, and related employment law matters please contact Toronto employment and immigration lawyers, Sultan Lawyers, at (416) 214-5111 or via email to mlahert@sultanlawyers.com.
