While mandatory vaccination with respect to COVID-19 remains unclear, it is unlikely that employers will be able to implement and enforce a requirement to get vaccinated without an order from provincial or federal health authorities as justification.

Although employers in Ontario have a duty under the Occupational Health and Safety Act (“OHSA”) to provide a safe workplace, it is not likely that the duty to provide a safe workplace will extend to mandatory vaccinations.
