In Ontario, most employees and employers are covered by the ESA.
However, the ESA does not cover employees and employers that fall under federal jurisdiction, including, but not limited to:
- Airlines;
- Banks;
- Post Office;
- Civil Service;
- Radio and Television networks; and
- Inter-Provincial railways.
Further, there are additional categories of individual workers, including independent contractors, to whom the ESA does not apply.
